Agreement to Terms and Conditions. By participating in and utilizing the information exchanged within Chermollist, administered by Chermol and Fishman LLC, I hereby acknowledge my acceptance of the following terms and conditions. This agreement serves as a mutual understanding between myself and Chermol and Fishman LLC, replacing any prior agreements of a similar nature. I am aware that access to Chermollist is a membership privilege granted by Chermol and Fishman LLC and may be rescinded should I violate the stipulations outlined in this agreement. I also commit to endorsing the terms of this agreement annually or as deemed appropriate by the organization.

I further acknowledge that upon registration, I will receive an initial email containing the Rules and Guidelines of Chermollist. I hereby agree to abide by and adhere to the Rules and Guidelines enclosed in that email. Failure to comply with these Rules and Guidelines may result in termination of my access to Chermollist.

Chermollist Rules and Guidelines

Email Submission Process: To join Chermollist, please send an email to admin@chermollist.com with the subject line containing your Initials, and Last Name as requested. In the body of the email, please provide your full name. The Chermollist administrator will carefully assess your request, and if approved, you will begin receiving emails from the list. Your patience during this process is appreciated.

Purpose and Scope: Chermollist provides a forum for regular members of Chermollist to exchange ideas, offer practice tips and seek advice related to the practice area of the list.

Critical Thinking and Discernment: Understand that content shared on the list is not necessarily reflective of absolute truth. Approach discussions with an open mind, and be prepared to evaluate information critically.

No Anonymous Posts: Include your real name and contact information in every message you post. Anonymity can hinder productive and accountable communication.

Descriptive Subject Lines: Craft subject lines that accurately summarize the content of your message. This helps recipients identify the topic at a glance.

Concise Posts Encouraged: Strive for brevity in your messages to enhance readability and engagement. Summarize key points and provide links for in-depth information.

Off-List “Thank You” and “Ditto” Messages: Express gratitude or agreement with individual members privately, rather than cluttering the list. Keep discussions focused on meaningful content.

Respectful Language: Avoid using foul language or offensive remarks in your posts. Foster a positive and respectful environment for all members.

Confidentiality of List Messages: Do not share Chermollist messages or information with anyone who is not a member of Chermollist.

Limited Product/Service Promotion: Advertise your products or services no more than once a year. Avoid repetitive self-promotion to maintain list integrity.

Treat Members with Respect: Interact with fellow list members in a respectful and considerate manner. Embrace diversity of opinions and backgrounds.

Practice Kindness: Strive to be friendly and supportive in your interactions. Fostering a positive atmosphere enhances the list’s value.

Avoid Defamation: Stick to verifiable facts and legitimate questions when discussing individuals or entities. Refrain from making defamatory statements that could harm someone’s reputation.

Postings regarding the Judiciary: When making a post to Chermollist to inquire about a local, state, or federal judge, please refrain from engaging in direct and hostile personal attacks. If you wish to provide feedback or criticism regarding any judge, kindly communicate privately and directly with the individual who made the inquiry. It’s important to note that critiques of judges should not be shared on Chermollist or any related forums.

Assumption of Risk and Liability: You are responsible for the content you post and assume all risks and liabilities associated with your contributions. You indemnify all list members, Chermol & Fishman LLC, and David Chermol for any potential defamatory posts, reposts, or replies.

Professional Conduct: Avoid engaging in behavior that could negatively impact the reputation of the profession. Refrain from associating with unsavory businesses or vendors.

Moderator’s Discretion: The list administrator reserves the right to remove disruptive or inappropriate members. Maintain professionalism and adhere to the established guidelines.

Copyright Compliance: Provide proper citations, brief quotes, or links for articles/news. Avoid posting full-text articles without permission. Respect copyright laws and avoid unauthorized distribution.

Defamation and Libel: Maintain respect, and avoid personal attacks. Focus debates on ideas, not individuals. False harmful statements can lead to legal consequences.

Limited Commercial Use: Avoid using the forum for communications primarily promoting business or financial interests. Prohibited communications include advertisements, rental notices or services, and direct solicitations for product or service purchases.

Exceptions for Profession-Related Content: You may share news of job openings, position listings, or discussions about professionally related products or services where you are not directly involved in sales. Ensure that your posts provide useful professional information rather than commercial promotion.

Political Neutrality: Do not use the list to endorse or oppose political candidates for any public office, which includes soliciting funds for political causes or candidates. Maintain political neutrality.

Research Participation Requests: Chermollist does not endorse or facilitate the forwarding of research participation requests through its platform. Researchers are kindly advised to directly engage with the respective divisions. Additionally, acknowledge the inherent limitations of utilizing Chermollist as a source for research samples.

Notify: If you have a complaint about a specific post or poster, email the administrator at admin@chermollist.com. Please do this in only truly extreme situations. In instances where you would like to change your email address, you must notify this request at admin@chermollist.com. Further, when you want to unsubscribe from Chermollist, please email admin@chermollist.com.
